The Recent Survey Results:
In accordance with the Deed Restrictions Sec.-1.03A, a Lot Owner may propose a change to the existing Deed Restrictions. Recently a Member has requested such a change and referendum (a vote of the Membership).
The Change:
Should a referendum be conducted to propose the following amendment to Section 1.03A1 of the Deed Restrictions:
“… A unanimous simple majority vote of the Board is required to approve the suggested proposal ….”
Currently for any item to be put before the Membership (Sec 1.03A1) in a referendum, a unanimous vote of the Board of Directors is required. This item failed to pass the Board.
However, 1.03A1 also provides the Membership the opportunity to override the Board of Directors through either a petition and/or a survey of the Membership. 300 Members can trigger the requirement for a referendum.
The survey and petitions are in, meeting the 300 Member threshold to hold the referendum. This item will appear as on the upcoming election ballot.
