Paper ballots for the current referendum were mailed on October 1, and electronic voting opened on October 5. On October 10, we held a Town Hall to review the proposed changes and answer questions from Members. Attendance was good, although it represented a relatively small percentage of our overall community.

One question raised at the Town Hall was, “Why do we have so many referendums?”

I believe this is an important question that deserves an answer for the entire Pine Ridge community.

One of the basic responsibilities of the Board of Directors is to enforce our governing documents. From time to time, those documents need to be updated, clarified, or corrected. Referendums are the means by which Pine Ridge Members decide what those documents should say. Ultimately, the governing documents belong to the Membership, and it is the Members who vote on proposed changes.

Why Do Our Documents Need to Be Changed?

In 2021, Pine Ridge undertook a major overhaul of its Deed Restrictions / Covenants. Many changes were made, and while most were considered significant improvements, weaknesses became apparent as the new provisions were put into practice. Those issues need to be addressed.

Earlier this year, the Membership also approved new tree and lot-clearing restrictions. As with any new set of requirements, some issues were not anticipated and have since been identified.

However, these are not the only reasons our governing documents require periodic maintenance. There are several sources of proposed changes.

  1. Administrative Corrections

Even a seemingly minor correction to our governing documents require a referendum. Under Florida Statute 720, amendments to applicable governing documents generally must follow the required amendment process. Whether the issue involves a misspelling, incorrect wording, or a transposed statute number, a formal vote is necessary to make the correction.

  1. Changes in Florida Law

When the Florida Legislature changes the law, those changes may conflict with provisions in our governing documents or make existing language outdated. When that happens, we may need to amend our documents to bring them into alignment with current law, reduce confusion, and ensure our requirements are consistent with applicable statutes. Changes to our documents must follow the required amendment process.

  1. Recommendations from the ADC, Manager, Staff, and Attorneys

Our ADC, Manager, staff, and attorneys work with these restrictions in their daily administration and enforcement. When they identify provisions that are vague, subjective, unfair in their application, or difficult to enforce, they may recommend changes to address those problems. The goal is to make our documents clearer, fairer, and more effective.

  1. Recommendations from Members

Members of our community sometimes bring concerns to the Architectural Design Committee (ADC) or the Board of Directors about provisions they believe are inadequate, unclear, or no longer appropriate. These concerns are reviewed, and when a change is warranted, a proposed amendment may be submitted to the Membership for a vote.

  1. Initiatives by the Board of Directors

The Board may also identify provisions that need to change as circumstances evolve or new issues arise. While the Board does initiate changes from time to time, this is probably the least frequent source of proposed amendments.

Your Vote Matters

Our governing documents are not static. They must be maintained as circumstances change, problems are identified, and laws evolve. Referendums provide Members with the opportunity to decide how Pine Ridge is governed and how our community’s restrictions are written.

A referendum is your opportunity to make your voice heard.

Whether you vote YES or NO, please take the time to participate. Every vote matters.

If you have questions about any of the current referendum items, please contact the Manager or any member of the Board of Directors. We will be glad to answer your questions and help you understand the proposed changes.

Thank you for participating in the process and helping shape the future of Pine Ridge.

The Pine ridge Board of Directors.
